Protecting Yourself Against Fraudulent Lawyers

Because a lawyer is a trained professional at law, we tend to trust them more than we do many other professions. In most cases this trust is well founded, as lawyers are generally honest and ethical people who are sincere in representing their clients. The problem is that lawyers are human like the rest of us and, as we all know, all avenues of life have their fair share of ‘bad eggs.’

Many motorists distrust towing companies because they seem more interested in making money out of accidents than caring for victims. They may be hesitant to consider the ethical honesty of their Florida truck accident lawyer. It is not until they are hurt before they realize they’ve suffered a wrong.

In most countries, Bar Associations fight for the right to keep their own colleagues honest by hearing any charges made against their fellows. In most cases it works well, as peers are often the best judge of their own when one of them transgresses. However, there is a movement in some states to strengthen the consumer laws so that legislation more tightly controls the activities of lawyers.

In one case, Cripe v. Leiter, the claimant wished to sue her lawyer under Illinois consumer fraud statute for over-billing. The claim against the lawyer was that the over-billing constituted fraud. The lower court found the lawyer was subject to the Illinois Consumer Fraud Act, and the State Supreme Court reversed the decision on appeal.

This means the lawyers’ own American Bar Association remains the place to hear fraud claims against their own.

Getting divorced is stressful, but it’s easier if you have a good lawyer to represent you and your interests. That’s especially true if you have a lot of assets to divide, or if there are children to support. Some couples have extenuating circumstances, too, and they need lawyers to help them because they aren’t sure how to divide certain things (or they can’t agree on how to divide them). If you’re in the position to afford a lawyer, or even if you think you can’t afford one but you need one, there are plenty of options for you. Just remember that every profession has unscrupulous people in it, and you don’t want to get taken or be a victim of fraud.

When hiring a divorce lawyer, choose someone who has a good reputation. If you have family members or friends who’ve been divorced recently, find out who they used. Search around online and see what kinds of reviews people are giving to lawyers. Make sure that you see if the law firm belongs to the Better Business Bureau and/or various legal organizations that establish credibility. Most divorce lawyers are good, and they will do all they can to help their clients, but others are only out to make money. You can avoid these with a little research and care, since they’re few and far between.

Even if you don’t think you really need a lawyer, you will want to get one if the other party to the divorce has one. It can be hard for you to fight against a lawyer, but another lawyer will be able to hold his or her ground. That can keep you from agreeing to something you didn’t mean to agree to, admitting anything that might be a problem, or simply becoming overwhelmed due to the legal proceedings.

Lawyers are already have a bad reputation in the eyes of common citizens and the media,

this recent research will further assist in destroying the little bit of respect that

people had for them. From fighting for huge criminals to saying pure white lies. From suing

multinational corporation for millions of dollars for a stupid reason to covering up the

truth in cases such as Exxon oil spill and the recent BP oil spill. There is one more black

mark on their list of unethical activities which makes them the butt of all jokes in the

society.

A recent survey conducted by the Economic Co-Operation and development authority has made

public the result of its year long survey. This results were recently unveiled which is

concluded after a global lawyer survey. This research also included lawyers from Europe and

other developed countries. This survey was focused on international corruption with the

assistance of lawyers to make both participating parties loyal. The results of the survey

showed that more than 95 countries around the world had abundant corruption. And these

corruptions were done under the watchful eyes of the jurisdiction of lawyers. Not just

local corruption but corruption on the international scale in trade and exchange. Also an

online survey was conducted which asked lawyers to say if they or if their friends are

taking part in international corruption. The corruption was more in Eastern Europe when

compared to the Western Europe but still is alarming. More than 70 % of the lawyers in

commonwealth countries and other independent states are part of this international

corruption. This survey was more based on an online survey, it needs to be properly

inquired to check if the large numbers of lawyers are seriously into this large scale

corruption. It is disappointing when a lawyer under an oath becomes a part of corruption

against the entire country.
